Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Roses & Lumber application and related services (the "Service"), provided by Roses & Lumber ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you use coaching, payment, or marketplace features (for example, charging members to join a pod), you must be at least 18 and able to form a binding contract. You are responsible for ensuring your use complies with the laws that apply to you.
2. Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
3. Subscriptions, Billing & Payments
- App subscriptions (e.g., paid feature tiers) are billed through the applicable app store (Apple App Store or Google Play) under their terms; manage or cancel them through your app-store account.
- Coach–member payments (paid pods and coaching) are processed by third-party payment providers such as Stripe. We are not the seller of coaching services and do not hold funds beyond what is required to facilitate a transaction.
- Except where required by law or an app-store policy, fees are non-refundable. Prices and features may change with notice.
4. Coaching Services & the Coach–Member Relationship
Roses & Lumber is a platform that connects coaches and members and provides tools for training, scheduling, and communication. Coaches are independent and are not our employees or agents. Any coaching relationship, program, price, or arrangement is solely between the coach and the member. We do not endorse, supervise, or guarantee any coach, program, or outcome, and we are not a party to those agreements.
5. Video Conferencing & Third-Party Integrations
The Service lets coaches connect their own third-party accounts — for example, Zoom — to schedule and host live sessions. If you connect such an account, you authorize us to create and manage meetings on your behalf and to store the credentials needed to do so. Your use of those third-party services is also governed by their own terms and policies, and we are not responsible for them. You may disconnect at any time; removing our app from the third-party provider will revoke that access.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose;
- Harass, abuse, or harm other users, or post content that is illegal, infringing, or objectionable;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Interfere with or disrupt the Service, or circumvent security or usage limits;
- Resell, scrape, or misuse the Service or its content without authorization.
7. User Content
You retain ownership of the content you submit (such as workouts, messages, and media). You grant us a limited license to host, process, and display that content solely to operate and improve the Service. You are responsible for your content and for having the rights to share it.
8. Intellectual Property
The Service, including its software, design, and branding, is owned by Roses & Lumber and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or to copy, modify, or create derivative works from the Service.
9. Health & Fitness Disclaimer
Roses & Lumber provides fitness and training tools and is not a medical service. Content and coaching are for informational purposes only and are not medical advice. Consult a qualified professional before starting any exercise program. You use the Service and participate in any activity at your own risk.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by law, Roses & Lumber will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.
12. Indemnification
You agree to indemnify and hold harmless Roses & Lumber from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms or of any law or third-party right.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will survive.
14. Changes to These Terms
We may update these Terms from time to time. The latest version will always be posted at www.rosesandlumber.com/terms-of-use. Continued use of the Service after changes take effect means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of the United States and the state in which Roses & Lumber operates, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless otherwise required by applicable law.
